On 28 October 2016 Greyhound Racing NSW (GRNSW) charged trainer Mr Robert Newstead under rules 106(2) and 86 (aa) of the GRNSW Greyhound Racing Rules as follows:
- That you, Robert Newstead, a registered trainer, did not exercise such reasonable care and supervision as may be necessary to prevent a greyhound in your care or custody from being subjected to unnecessary pain or suffering at The Gardens race track on or around 26 July 2012 where it is alleged that:
(a) you placed a greyhound in the starting box;
(b) you held an electric prod and pointed it into the starting box;
(c) when the lure travelled past the starting boxes, you ‘shocked’ the greyhound with the electric prod; and
(d) ‘shocking’ the greyhound with an electric prod would have caused the greyhound unnecessary pain and/or suffering;
- That you, Robert Newstead, a registered trainer, used an item to affect the performance or behaviour of a greyhound at The Gardens race track on or around 26 July 2012 where it is alleged that:
(a) you placed a greyhound in the starting box;
(b) you held an electric prod and pointed it into the starting box;
(c) when the lure travelled past the starting boxes, you ‘shocked’ the greyhound with the electric prod; and
(d) ‘shocking’ the greyhound with an electric prod to affect the performance or behaviour of a greyhound.
